Biography

Mike Gergel is the Director of Information Protection and Security at Rutgers University. He leads the efforts in the areas of information security threat detection and management, awareness, incident response and supporting customer and regulatory obligations including the Gramm Leach Bliley Act (GLBA), New Jersey Identity Theft Protection Act, and the Payment Credit Card Industry (PCI) Data Security Requirements. In addition to his current position at Rutgers, Mike has held senior information security positions at Fortune 500 companies, where he was responsible for the establishment and implementation of information security programs and controls. Mike completed his BA in Computer Science at LaSalle University, and also earned a MBA from Philadelphia University. Mike holds the Certified Information Systems Security Professional (CISSP) certification from ISC2.

Chris Miles, founder and CEO of Miles Technology, Miles Computer Forensics, a division of Miles Technologies, Inc., is a leader in forensic and technology consulting, offering nationwide service to law firms, government agencies, regulators, corporations and their general counsel. Abstract

Data Breaches
It is now frequent that consumers receive notification from an educational institution advising them that their personal data has been compromised, and that they may need to take steps to protect themselves from identity theft. According to the Identity Theft Resource Center, in 2007 there were 446 identity breaches throughout the United States, and of these breaches approximately one quarter occurred at educational institutes. A privacy breach can have a devastating impact to an institute if not handled appropriately, and can have damaging financial and reputation consequences. Well defined processes are essential in ensuring that appropriate steps are taken in the event of a privacy breach, and in determining whether notification is required. This presentation will discuss the essential elements and processes of an effective breach and notification plan, and will describe the critical decisions that need to be made during the different phases of the breach.

E-Discovery
In the digital age, the rapid growth of computer usage has created unprecedented challenges for organizations and their legal representatives. The world of paper evidence is being replaced by electronic data, making the computer the key component in the discovery, collection, investigation, and production of evidence.

Neither the human eye, nor a computer's operating system can view deleted data on a computer's hard drive. This can include internet, email activity, files, documents, and spreadsheets. This key evidence can be acquired by forensics professionals utilizing specialized hardware, software, and technical expertise. The evidence must be acquired and preserved using strict forensic processes, in order to ensure that it will stand up in court.

Electronic discovery is a challenge in today's technological environment for both litigators and corporate general counsel. An expert is imperative in assisting in the areas of electronic discovery consulting, preservation of data, computer forensics, and readiness planning, throughout the litigation cycle.
